for Youmanage Electronic Signature Software (UK)

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the electronic signature services (“Services”) hosted in Youmanage by WorkNest Ltd (“we”, “us”, or “our”), a non-qualified trust service provider under the UK eIDAS Regulation, as amended by the Electronic Identification and Trust Services for Electronic Transactions Regulations 2016 and the Data (Use and Access) Act 2025.
By using our Services, you agree to these Terms. If you do not agree, you must not use the Services.
2. Scope of Services
We provide electronic signature services that enable users to create advanced electronic signatures. We are not a qualified trust service provider and do not issue qualified electronic signatures under UK law.
3. Legal Effect of Signatures
Under the UK eIDAS Regulation, electronic signatures created using our Services may be legally valid and admissible in UK courts. However, they do not benefit from the automatic legal equivalence to handwritten signatures that qualified electronic signatures do.
4. User Responsibilities
You agree to:
– Provide accurate and truthful information.
– Use the Services in compliance with UK law.
– Maintain the confidentiality of your login credentials.
– Ensure that your use of electronic signatures is appropriate for your legal and business needs.
5. Limitations of Liability
We are not responsible for:
– The legal enforceability of signatures in jurisdictions outside the UK.
– Any loss or damage resulting from reliance on our Services for transactions requiring qualified trust services.
– Unauthorised access due to your failure to secure your account.
6. Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and the Data (Use and Access) Act 2025. Please refer to our Privacy Policy for more details.
7. Trust Service Status
We are a non-qualified trust service provider and do not use the UK trust mark reserved for qualified services. Misrepresentation of our trust status is prohibited and may result in legal action.
8. Termination
We may suspend or terminate your access to the Services at our discretion, particularly in cases of misuse or breach of these Terms.
9. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the UK courts.
